This act was duly accepted by the company. The fund commissioner was appointed, the mortgage executed, the bonds issued by the company and sold by the fund commissioner, and the money arising from such sales and from the earnings of the road was applied by him in the manner provided in the act. The fund commissioner continued in the discharge of the duties imposed by the act until October, 1868, when his office was abolished, the bonds being at that time still unpaid.
